Privacy Policy
Last updated: October 1, 2026
This Privacy Policy explains how Kimberly Cunningham (“we,” “us,” or “our”) collects, uses, shares and protects information when you visit kimberlycunningham.com (the “Site”), subscribe to our emails, or contact us about speaking, training or media. By using the Site you agree to this Policy. If you do not agree, please do not use the Site.
1. What this Site is — and is not
This Site is Kimberly Cunningham’s personal, educational and professional website. It provides general health education and information about her book, speaking engagements and provider training.
This Site is not a patient portal, is not used to deliver medical care, and is separate from Cunningham Clinic’s website and patient record systems. Nothing on this Site creates a provider–patient relationship, and nothing here is individualized medical advice. Always consult your own licensed healthcare provider about your personal situation.
2. Please do not send us health information
Our forms and email are intended for general, professional and business inquiries only. Please do not submit medical history, symptoms, diagnoses, medications, lab results, insurance details or any other health information through this Site or by email. Information you send through this Site is not protected health information under the Health Insurance Portability and Accountability Act (HIPAA), and HIPAA’s protections do not apply to it.
If you are a current or prospective patient of Cunningham Clinic, please use the clinic’s own secure channels. Cunningham Clinic’s Notice of Privacy Practices governs how the clinic handles patient information; it is available from the clinic directly.
3. Information we collect
Information you give us
- Speaking inquiries: your name, organization, email address, phone number, and details about your event (name, date, location, website, audience, requested format, topic, budget range and message).
- Training interest: your name, email address, professional credential or role, practice or organization, areas of interest, preferred format and any message.
- Email sign-ups: your email address when you subscribe to updates or ask to be notified about new videos.
- Correspondence: anything you choose to include when you email us.
Information collected automatically
- Server and security logs: our hosting provider automatically records technical information such as your IP address, browser type, device type, referring pages, pages viewed and timestamps, used to operate and secure the Site.
- Cookies: the Site uses only the essential cookies needed for WordPress and our forms to function. We do not currently use advertising cookies or third-party analytics trackers. If we add analytics in the future we will update this Policy and, where the law requires it, ask for your consent first.
Third-party content and links
- Fonts: the Site loads typefaces from Google Fonts, which means your browser sends a request (including your IP address) to Google when pages load. Google’s privacy policy applies to that request.
- Embedded videos: when we embed YouTube videos, YouTube (Google) may set cookies and collect viewing data once you play a video.
- External links: the Site links to Amazon (to purchase the book), to CunninghamClinic.com and to other third-party sites. We do not control those sites, and their privacy policies govern your use of them.
4. How we use information
- To respond to speaking, media, podcast and training inquiries and to arrange engagements.
- To send you emails you have asked for, such as video announcements, book news, event dates and provider-education updates.
- To operate, maintain, secure and improve the Site.
- To comply with legal obligations and to protect our rights, the Site and its users.
Where European or United Kingdom data-protection law applies, we rely on your consent (for marketing emails), our legitimate interests (operating the Site and responding to inquiries) and, where relevant, the need to take steps toward a contract (such as a speaking agreement).
5. Email communications
We send marketing or informational emails only to people who have opted in. Every such email includes an unsubscribe link, and you may also unsubscribe at any time by emailing us. We honor opt-out requests promptly in accordance with the CAN-SPAM Act and similar laws. Transactional replies to your inquiries are not marketing emails.
6. How we share information
We do not sell your personal information, and we do not share it with third parties for targeted advertising. We share information only:
- With service providers who help us run the Site and communicate with you — for example our web host, our website platform (WordPress and Elementor, which stores form submissions in our website database), our email delivery provider and, when connected, our email-marketing platform. These providers may use the information only to perform services for us.
- With Cunningham Clinic only if you ask us to pass along a message about becoming a patient.
- When required by law or to respond to lawful requests, protect safety, enforce our terms or protect our rights.
- In a business transfer, if the Site or its assets are transferred, subject to this Policy.
7. How long we keep information
- Speaking, media and training inquiries: for as long as needed to respond and for reasonable business records, generally no longer than three years after our last contact.
- Email subscriptions: until you unsubscribe or ask us to delete your address.
- Server logs: according to our hosting provider’s standard retention schedule.
8. Security
The Site is served over HTTPS, access to form submissions is limited to authorized administrators, and we use reputable hosting and software providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security — another reason we ask you not to send sensitive health information through the Site.
9. Children
The Site is intended for adults. It is not directed to children under 13, and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us information, please contact us and we will delete it.
10. Your choices and rights
Depending on where you live, you may have the right to access, correct, delete or receive a copy of the personal information we hold about you, to opt out of marketing, and to object to or restrict certain processing. Colorado residents have rights under the Colorado Privacy Act, California residents under the California Consumer Privacy Act, and residents of the European Economic Area and United Kingdom under the GDPR and UK GDPR, in each case to the extent those laws apply to us.
To exercise any of these rights, email [email protected] or use the inquiry form on our Speaking page. We will verify your request and respond within the time required by applicable law (generally 45 days). You may authorize an agent to act for you where the law permits. We will not discriminate against you for exercising your rights. If we deny your request, you may appeal by replying to our response.
We do not currently respond to browser “Do Not Track” signals, as there is no common standard. Where required by law, we honor opt-out preference signals such as Global Privacy Control.
11. International visitors
The Site is hosted and operated in the United States. If you visit from outside the United States, your information will be transferred to and processed in the United States, where privacy laws may differ from those in your country.
12. Changes to this Policy
We may update this Policy from time to time. The “Last updated” date at the top shows when it was last revised, and material changes will be noted on this page. Your continued use of the Site after a change means you accept the updated Policy.
13. Contact
Questions or requests about this Policy: [email protected]. For questions about Cunningham Clinic patient privacy, please contact the clinic directly through cunninghamclinic.com.
